Authorize the County Administrator or his designee to execute Change Order 19 to Agreement 13-1142BG for Construction Manager at Risk Services for Fleet Transit Facility with Willis A. Smith Construction, Inc., of Sarasota, Florida in the amount of $497,896.29 and adding sixty-two (62) calendar days to the schedule.

Background Discussion

Change Order 19 provides for the Manatee County Traffic Design and Florida Department of Transportation required operational and safety improvements which include adding an additional lane for  separate left, thru, and right lanes on eastbound Tallevast Road at US 301, expanding the right turn lane on Tallevast Road into the facility, the addition of an eastbound left turn lane on Tallevast Road into the facility, and extending the southbound right turn lane and the northbound left turn lane on US 301 for added capacity.

As a result of the added scope of road work, the Agreement is increased by $497,896.29. This net change adjusts the current amount of the Agreement from $13,615,914.21 to $14,113,810.50 and adds sixty-two (62) calendar days to the schedule, which changes the final completion date to August 8, 2016.

Pursuant to Article IV, Section 4.5 of the Agreement, the previous Change Orders were executed as deductive change orders from Owner Direct Purchases and internal accounting changes.

Additional Background:

The Public Works complex located at 1022 26th Ave E, Bradenton, Florida currently houses Manatee County Area Transit (MCAT) and Fleet Services; however, the current facility is inadequately equipped to serve current and projected transit and transit-related fleet needs.

The Manatee County Board of County Commissioners has received a Federal Transit Administration (FTA) Section 5309 State of Good Repair Grant to design and construct a new state-of-the-art complex to house transit and transit related services. The scope of the Construction Manager at Risk for the Fleet Transit Facility includes build-out on a 37.71 acre parcel at the northwest corner of Tallevast Road and US 301 to include an estimated 116,000 square foot footprint for transit, on-site fleet services, and fuel services including 95 fixed route buses, 47 paratransit buses, 38 ambulances, and 56 support vehicles.

On April 6, 2014, the Board of County Commissioners executed Agreement No. 13-1142BG for Construction Manager at Risk Services for Fleet Transit Facility with Willis A. Smith Construction, Inc., of Sarasota, Florida at a not to exceed amount of $120,000.00 for pre-construction services to include the development of a Guaranteed Maximum Price (GMP) and schedule for construction.

On December 15, 2014, Amendment No. 1 was executed to amend FTA clauses in the Agreement.

On January 13, 2015, the Board of County Commissioners executed Amendment No. 2 - Acceptance of GMP in the amount of $15,395,421.00.

On June 11, 2015, Amendment No. 3 was executed to incorporate Exhibit "E" entitled "Owner Direct Purchases" into the Agreement as a reference in Article IV, Section 4.5 "Direct Acquisition by Owner" of the Agreement.
