Action Requested
  • Execution of Contract for Sale and Purchase for a Warranty Deed with Xuan Tan Nguyen and Binh Kim Bui in the amount of $87,750.00; and
  • Execution of Contract for Sale and Purchase of a Temporary Construction Easement in the amount of $450.00.


Enabling/Regulating Authority
Chapters 125 and 127, Florida Statutes.  Manatee County Comprehensive Plan Goal 5.1 addresses the safety and efficiency of forecasted vehicular demands.

Background Discussion
  • The 45th Street East road improvement from SR 70 to 44th Avenue East project was approved in the FY 2013-2017 CIP 382-6025562.
  • Parcels 117/717 are improved with a single-family residence located at 5126 45th Street East.  The project requires a partial take of 3,251 square feet.  In addition, a temporary construction easement of 169 square feet is required.
  • On February 25, 2015, Appraiser Shawn Wilson, MAI, of Compass Real Estate Consulting, Inc., determined the value of the area for acquisition at $87,000.00.  The Temporary Construction Easement is valued at $200.00. 
  • The appraisal value detail consists of the following: $9,800.00 for land; $4,400.00 for improvements to include shell/driveway, sod, RCP underground pipe, bushes, vines, fruit trees, tree and irrigation system; $1,000.00 for cost to cure replace landscaping and modify the irrigation system; and $71,800.00 for severance damages as a result of the acquisition.
  • The loss in value caused by the taking, but not attributable to the part taken, represents severance damages to the remainder.
  • A settlement was reached at $88,200.00 for the acquisition and eliminates additional costs for litigation fees or expert fees associated with this agreement.
