Action Requested
Adopt Manatee County Resolution 15-054, extending the Certificate of Level of Service (CLOS) 04-111 for Creekwood East Corporate Park.

Background Discussion

• Applicant is requesting an extension to CLOS #04-111 for two years, which will give a new expiration date of 04/14/2017.
• Section 510.9.3 of the Manatee County Land Development Code allows the Board of County Commissioners to extend a CLOS up to two years, when the CLOS was originally issued for three years; which has occurred.
• The project is located on the east side of I-75, north of SR 70, on the east and west sides of Lena Road in the Creekwood DRI.
• An overall preliminary site plan and final site plan was initially approved administratively by staff on 10/18/2001.  The overall final site plan has been administratively amended several times.  The current CLOS was issued with the second amendment to the final site plan in 2005.  A final site plan must be reviewed and approved for each individual lot.  Nineteen of the approved 32 lots are vacant.
• The CLOS was originally issued on 04/14/2005 for 3 years.  The CLOS has been extended twice by County resolution for five years combined and at the applicants request once pursuant to legislative House Bill 503 for two years.  The CLOS recently expired on 04/14/2015, however, the County received the applicant’s extension request prior to the expiration and in accordance with the Land Development Code.
• Capacity has been reserved for solid waste, traffic circulation, potable water, sanitary sewer, and drainage.
• The project is approved for 800,000 square feet of industrial uses.  All concurrency related transportation improvements have been constructed.
