Action Requested
  1. Execute and record Final Subdivision Plat;
  2. Record Declaration of Covenants, Conditions and Restrictions for the Estuary;
  3. Accept, execute, and record Mortgagee's Joinder in and Ratification of  (I) The Subdivision plat and all dedications and reservations thereon for the plat entitled "Estuary"; and (II) The declaration of covenants, conditions, and restrictions for The Estuary, and all reservations, covenants, and restrictions therein from Robinson Farms, Inc.;
  4. Authorize the County Administrator to record Consent and Joinder from Robinson Farms;
  5. Authorize the County Administrator to record Consent and Joinder from Neal Communities of Southwest Florida, LLC;
  6. Authorize the County Administrator to record Affidavit of Ownership and Encumbrances;
  7. Authorize the County Administrator to re-record the Permanent Utilities Easement; 
  8. Authorize the County Administrator to accept, execute, and record Agreement for Private Subdivision with Private Improvements from Neal Communities of Southwest Florida, LLC;
  9. Authorize the County Administrator to accept, execute, and record Agreement for Private Subdivision with Public Improvements from Neal Communities of Southwest Florida, LLC;
  10. Authorize the County Administrator to accept and execute Surety Bond for Performance of Required Private Improvements, Bond No. CS9826738 from Great American Insurance Company for $3,361,006.68; 
  11. Authorize the County Administrator to accept and execute Surety Bond for Performance of Required Private Improvements, Surety Bond No. CS9826736  from Great American Insurance Company for $68,445.00;
  12. Authorize the County Administrator to accept and execute Surety Bond for Performance of Required Public Improvements, Bond No. CS9826737 from Great American Insurance Company for $1,055,496.00.


Enabling/Regulating Authority
  • MANATEE COUNTY LAND DEVELOPMENT CODE ORDINANCE 15-17, AS AMENDED;
  • MANATEE COUNTY COMPREHENSIVE PLAN, FUTURE LAND USE ELEMENT GOAL 2.4, ADEQUATE PUBLIC FACILITIES IN ALL DEVELOPED OR DEVELOPING AREAS.  The project has been issued a Certificate of Level of Service for Potable, Solid Waste, Sanitary Sewer, Transit, Drainage, Traffic, and Fire Protection, Objective 2.4.2 Concurrency, CLOS-14-009.


Background Discussion
  • The final plat is for a private, single-family subdivision with 50 lots.
  • The potable water, reclaimed water, and wastewater infrastructure facilities within this private road subdivision will be publicly owned and maintained by Manatee County. The applicant has elected to plat the subdivision prior to its construction; as a result, the applicant has provided a performance bond for platting purposes for all future private and public infrastructure improvements. As part of the proposed public utilities within this private street subdivision, there are required Agreements for Subdivision Improvements along with a Bill of Sales to Manatee County for utility infrastructure improvements; these documents shall be executed and recorded.
  • All common areas will be maintained by the Estuary Neighborhood Association, Inc.
