Action Requested
  • Execution of a Contract for Sale and Purchase for a Warranty Deed with Sabal Harbour Homeowners Association, Inc., in the amount of  $33,400.00, and;
  • Execution of a Contract for Sale and Purchase of a Temporary Construction Easement with Sabal Harbour Homeowners Association, Inc., in the amount of $7,100.00.


Enabling/Regulating Authority

Chapter 125 and Chapter 127, Florida Statutes.  Manatee County Comprehensive Plan Goal 5.1 addresses the safety and efficiency of forecasted vehicular demands.



Background Discussion
  • The 45th Street East road improvement project from SR 70 to 44th Avenue East was approved in the FY 2013-2017 CIP 382-6025562.
  • Parcel 109 is a partial acquisition consisting of  3,728 square feet of residential subdivision common area uplands and buffer wetlands with a fence appraised at $6,600.00.
  • Parcel 110 is a partial acquisition consisting of 2,494 square feet of a common area upland buffer with sod/grass appraised at $16,300.00.
  • A settlement was reached for both parcels at $27,400.00 plus $6,000.00 for professional fees totaling an acquisition cost of $33,400.00.
  • Parcel 721 is a temporary partial acquisition consisting of 2,399 square feet of common area with sod, landscaping, paving, and signs appraised at $6,100.00. 
  • A separate settlement for Parcel 721 was reached at $7,100.00 .
  • The agreed settlements avoid possible additional expenses for expert witness fees and continued litigation.
