Adoption of, authorization to record, Resolution R-13-051 vacating certain unimproved rights of way of record for Manatee County.

Background: The applicants, Jeffrey Eickelmann and Jennifer Eickelmann; Jacqueline D. Weachock, as Trustee of the Florida Land Trust u/a dated 12/18/09; Kevin Cross, as Trustee of the Cross Irrevocable Trust Agreement dated 3/25/98 and Advanta IRA #8003010; and Michael A. Schue and Kelly Rae Schue are requesting that a portion of unimproved right of way of 65th Avenue East and 221st Street East be vacated. The proposed vacation area is described as a portion of Pomello Park, a subdivision, recorded in Plat Book 6, Page 61, containing a total of 2.3 acres, and is located north of State Road 70 and west of Waterbury Road. The applicants' parcels are improved with single family homes. There was a previous vacation of a portion of 65th Avenue East located adjacent to the west side of the proposed vacation area recorded in Official Records Book 1705, page 2211 (copy attached).
Purpose of Request: The applicants are requesting to maintain their property line in cooperation with neighbors to insure security and privacy.
County and Utility Company Review: Jurisdictional Review by appropriate County Departments and Private Utility Agencies serving the location to be vacated have been notified of the applicants’ intention to file a vacation, and have no objection nor any conditional requirements. The proposed vacation does not land lock adjacent lot owners properties. This vacation would serve only the applicants and complies with the technical requirements of the County's Land Development Code and pertinent Florida Statutes.
Fiscal Impact: All expenses associated with the subject application, its approval, and recording will be paid by the Applicant. The application filing fee of $800 has been paid.
