  • Execution of Deed to RaceTrac Petroleum, Inc., a Georgia corporation.


Enabling/Regulating Authority
Section 125.35, Florida Statutes, County Government authorized to sell real and personal property and to lease property.

Background Discussion
  • On October 11, 2016, the Board of County Commissioners adopted Resolution R-16-146 declaring property located at the northwest corner of US 301 North and Ellenton-Gillette Road as surplus and authorized its sale.
  • On January 10, 2017, the Board of County Commissioners executed the Contract for Sale and Purchase between Whisenant Family Limited Partnership and Manatee County for this surplus parcel in the amount of $98,381.50.
  • The Whisenant Family Limited Partnership, the Buyer, is authorized in the Contract for Sale and Purchase to assign this contract but requires them to provide Manatee County, the Seller, written notice of said assignment.
  • This Assignment and Assumption of Contract for Sale and Purchase from Whisenant Family Limited Partnership which assigned the contract to RaceTrac Petroleum, Inc., was provided to Property Acquisition to meet the written notice contract requirement.
  • The executed deed is needed in order to complete this transaction with the closing scheduled for June 23, 2017.
