Background Discussion

Manatee County has jurisdiction over a road right-of-way known as 48th Street Court East north of Manatee Avenue.  A portion of the right-of-way adjacent to I-75 was acquired for state or federal highway purposes and conveyed to the County by the Florida Department of Transportation.

The property on both sides of the subject right-of-way between I-75 and the Manatee River is located within the boundaries of the City of Bradenton.  Almost all of the property north of Manatee Avenue on the east side and approximately half of the property along the west side of 48th Street Court East has been annexed into the City of Bradenton.

Section 335.0415, Florida Statutes, provides that a governmental entity may transfer jurisdiction over public roads and right-of-way to another governmental entity by mutual agreement.  The City of Bradenton has agreed to accept jurisdiction over the right-of-way for 48th Street Court East located north of Manatee Avenue.

Attached are copies of an Agreement for Transfer of Jurisdiction of Public Road and Right-of-Way and a Quit-Claim Deed transferring the property from Manatee County to the City of Bradenton.  According to the Agreement, the County will have access to the right-of-way and responsibility for operation, maintenance, and repair of any County utilities in the right-of-way.  The Deed reserves a non-exclusive permanent utility easement in the property of Manatee County construction, installation, operation, maintenance, repair, replacement, relocation, and removal of potable water, wastewater, and reclaimed water utility systems.

Staff recommends approval of the attached Agreement and Deed.
