Action Requested
Execution of Contract for Sale and Purchase for a Permanent Easement from Barnsleywarne Properties, LLC for the Ft. Hamer Road waterline project in the amount of $10,000.

Enabling/Regulating Authority
Chapters 125 and 127, Florida Statutes. Manatee County Comprehensive Plan - Goal 11.5-11.7 Addresses the potable water system.

Background Discussion

The Ft. Hamer Road waterline project was approved in the FY 11-15 CIP on September 16, 2010, Resolution R-10-180. The Project is for the purpose of installing a subaqueous waterline to connect the area north of the Manatee River to the south side of the river to enhance the North County water service to create a loop back-up system.

The property is located at 12151 Mulholland Road on the east side of Ft. Hamer Road and north of the Manatee River. The parcel is numbered 806.

An appraisal by Burl Wilson of Wilson Real Estate, Inc., on December 19, 2012, for parcel 806 valued the land at $1,200 with no damages and no cost to cure for a total of $1,200.

A settlement was reached at $10,000. The settlement  is a negotiated figure representing a litigation avoidance settlement which eliminates additional costs for litigation fees for attorneys, property appraisers, land planners, engineers and surveyors.

The Contract for Sale and Purchase for a Permanent Easement is hereby presented to the BCC for execution in the amount of $10,000.
