Action Requested

Authorization to issue payment for reimbursement of moving expenses associated with the acquisition of Parcels 109A, 109B, and 109C required for the 44th Avenue East Project (30th Street East to 45th Street East) in the eminent domain case of Manatee County v. Keeping Kids in Their Home Foundation Corp., as Trustee for Abundant Life Trust, etc., et al., Case No. 2014-CA-1299.

Article X, Section 6 of the Florida Constitution, along with Chapters 73, 74, and 127, Florida Statutes.

Background Discussion

Manatee County proposes to improve 44th Avenue East from 30th Street East to 45th Street East.  This project is a CIP-approved project.

Parcels 109A, 109B, and 109C are total acquisitions of property located on the east side of 37th Street East.  The subject property located on Lot 1, Marland Subdivision, is improved with a 2-story single-family residence comprising of 1.291 acres and is located at 4419 37th Street East, Bradenton.  The subject property located on Lot 2, Marland Subdivision, is improved with a single-family residence comprising of 1.003 acres and is located at 4423 37th Street East, Bradenton.  Both residences are tenant occupied by members of the Marland family.

On June 3, 2014, the landowner, Keeping Kids in Their Home Foundation Corp., as Trustee for Abundant Life Trust, a California Trust, and Manatee County stipulated to the acquisition of Parcels 109A, 109B, and 109C (Stipulated Order of Taking attached).  As a part of negotiations, the landowner agreed to stipulate to the acquisition of the parcels in exchange for the County’s agreement to reimburse its tenants’ moving expenses up to a maximum amount of $6,300.

The County received an invoice and cancelled check for the tenants’ moving expenses in the amount of $6,300, attached, and payment for reimbursement of those expenses is hereby requested.
