2017 Update to School Impact Fees - Time Certain 9:00 am

Based upon the Staff Report, evidence presented, comments made at the Public hearing, and finding the Manatee County School Impact Fee Study, dated May 9, 2017, to be CONSISTENT with the Manatee County Comprehensive Plan and in accordance with Land Development Code, the Planning Commission recommends that the Board of County Commissioners ADOPT Manatee County Ordinance 17-46, amending the Manatee County Code of Ordinances, as recommended by staff.
In the state of Florida, impact fees are regulated by the Florida Impact Fee Act, which was enacted by the Florida Legislature in June, 2006. The Act requires all impact fees imposed in the state to be based on the most recent and local data available. The Manatee County School District last updated its impact fee schedule in 2015.
The School Board retained TischlerBise to prepare the Manatee County Impact Fee Study dated May 9, 2017. The School Impact Fee Study documents the cost and credit methodologies for determining the impacts of new development on Educational Facilities.
Manatee County School District prepared a new Impact Fee Study for public educational facilities, titled Manatee County School Impact Fee Study, May 9, 2017. Amendments to the Code of Ordinances presented herein are limited to recognizing the new study and revising the impact fee schedule for educational facilities.
Impact fees are one–time fees assessed on new development. When new dwellings are constructed, they impact County educational facilities with new students. Impact fees assist the Manatee County School District by providing funds to increase school capacity for additional students. Impact fees cannot be used to replace, maintain, or rehabilitate existing school facilities. School impact fees are collected countywide.
On November 8, 2016, the voters of Manatee County approved a fifteen-year extension of the one-half cent sales tax for school capital expenditures. The consulting firm TischlerBise reviewed changing local conditions, including the economic impact of the sales tax extension, resulting in revisions to impact fee credit calculations.
On May 23, 2017, the School Board adopted Resolution 2017-05, accepting the TischlerBise impact fee study titled Manatee County School Impact Fee Study, May 9, 2017, and transmitting the resolution to the Board of County Commissioners of Manatee County with a request to implement the Impact Fees. The impact fee schedule for educational facilities is required to be adopted by the Board of County Commissioners and incorporated in the Code of Ordinances.
