Rosedale Utilities Transfer Agreement

Authorize the County Administrator to execute the Agreement for Sale and Transfer of Water and Wastewater Facilities regarding Rosedale and Rosedale Highlands.
Section 125.01, Florida Statutes, Chapter 153, Florida Statutes, Chapter 63-1598, Laws of Florida, as amended, Chapter 2-31, Article IV, Manatee County Code of Ordinances.
Rosedale Master Homeowner's Association, Inc. is the homeowners association for the residential development known as Rosedale 1 through 11 and Rosedale Highlands subphases A through D.
The Association owns - through title to the original developer - water and wastewater facilities located within the Development and is solely responsible for the maintenance of said facilities.
The Association desires to transfer ownership of the water and wastewater facilities within the Development to the County.
It is Manatee County's established requirement that private utility systems be brought to current code and standards prior to transfer or purchase.
Negotiations have transpired and agreement reached on the improvements needed and process for completing such upgrades.
It is staff's recommendation to execute the Agreement for transfer of the system to Manatee County Utilities.
