Action Requested

Authorization for the Chairman to execute Long Bar Pointe Drainage Facility Relocation Agreement with Cargor Partners VIII, Long Bar Pointe, LLLP (Developer) to relocate existing County owned and maintained stormwater retention facility and incorporate into proposed stormwater management system for the proposed Long Bar Pointe, Phase 1, Parcels C & B2 planned development project.

Background Discussion
  • The County constructed drainage facilities (retention ponds) along the Right-of-Way of El Conquistador Parkway to manage stormwater runoff.
  • The County is presently responsible for maintenance and re-certification of these drainage facilities.  These existing drainage facilities are included in a recorded Drainage/Stormwater Easement (O.R. Book 2374, Pages 3755-3765).
  • The Developer is proposing a Planned Development Residential project consisting of 200 dwelling units.  These site improvements affect the location of one of the existing County maintained drainage facilities.
  • The Developer, in coordination with staff, has crafted the subject Agreement to relocate the County drainage facility into a proposed onsite retention pond including associated conveyance and outfall systems.
  • The Developer is responsible for the cost associated with design, permitting, and construction of the relocated stormwater facility, conveyance systems, and outfall systems.  In addition, the Developer is not seeking impact fee credits for the stormwater facility relocation.
  • Maintenance of the proposed relocated drainage facilities including retention ponds, conveyance, and outfall system will be the responsibility of the Developer or their designees.  The existing Drainage/Stormwater Easement referenced above would be vacated.
  • The County would accept a Public Flowage Easement to maintain the free flow of drainage runoff from El Conquistador Parkway should the Developer or their designees fail to maintain the proposed drainage facilities in functioning order.

All costs associated with design, permitting, and construction of the relocated stormwater facility and conveyance/outfall systems shall be borne by the Developer.  In addition, the Developer is not seeking impact fee credits for the stormwater facility relocation.
