  1. Execute and record Final Subdivision Plat;
  2. Accept, execute, and record Mortgagee's Joinder in Ratification of Subdivision Plat and All Dedications and Reservations Thereon from First Continental Investment Co., Ltd.; 
  3. Accept, execute, and record Mortgagee's Joinder in Ratification of Subdivision Plat and All Dedications and Reservations Thereon from American Momentum Bank;
  4. Record Community Declaration for Moss Creek;
  5. Authorize the County Administrator to accept, execute, and record Agreement for Private Subdivision with Public Improvements for Moss Creek, Phase I from CND-Moss Creek, LLC
  6. Authorize the County Administrator to accept, execute, and record Agreement for Private Subdivision Improvements with Private Improvements for Moss Creek, Phase I from CND-Moss Creek, LLC;
  7. Authorize the County Administrator to accept and execute Surety Bond for Performance of Required Public Improvements, Moss Creek Phase I, Surety Bond No. K0960778A from Westchester Fire Insurance Company for $1,275,563.07;
  8. Authorize the County Administrator to accept and execute Surety Bond for Performance of Required Private Improvements, Moss Creek Phase I,  Surety Bond No. K09607791 from Westchester Fire Insurance Company for $1,974,911.93;
  9. Authorize the County Administrator to accept and execute Surety Bond for Performance of Required Private Improvements, Moss Creek Phase I,  Surety Bond No. K09607808 from Westchester Fire Insurance Company for $617,185.40.


Enabling/Regulating Authority
  • MANATEE COUNTY LAND DEVELOPMENT CODE ORDINANCE 15-17, AS AMENDED;
  • MANATEE COUNTY COMPREHENSIVE PLAN, FUTURE LAND USE ELEMENT GOAL 2.4, ADEQUATE PUBLIC FACILITIES IN ALL DEVELOPED OR DEVELOPING AREAS.  The project has been issued a Certificate of Level of Service for Potable, Solid Waste, Sanitary Sewer, Transit, Drainage, Traffic, and Fire Protection, Objective 2.4.1, Concurrency, CLOS-16-007


Background Discussion
  • This Final Subdivision Plat is for 74 residential lots. 
  • The Developer has posted Surety Bonds to warrant the required public and private infrastructure improvements - sewer, water, roadway, surveying, landscape-irrigation, and drainage.
  • All common areas will be maintained by Moss Creek Property Owners Association, Inc.
