Action Requested
1.Execute and record Final Subdivision Plat.
2.Record Supplement and 5th Amendment to the Declaration of Covenants, Conditions, and Restrictions of Del Tierra.
3.Authorize the County Administrator to accept, execute, and record Agreement for Private Subdivision with Public Improvements for Del Tierra Phase IVB and IVC from D.R.Horton, Inc.
4.Authorize the County Administrator to accept, execute, and record Agreement for Private Subdivision with Private Improvements for Del Tierra Phase IVB and IVC from D.R. Horton, Inc.
5.Authorize the County Administrator to accept and execute Surety Bond for Performance of Required Improvements, Survey Bond No. SNN4007860 from Nationwide Mutual Insurance Company for Water, Sewer and Reclaimed in the amount of $816,046.40.
6.Authorize the County Administrator to accept and execute Surety Bond for Performance of Required Private Improvements, Surety Bond No. 1153386 from Lexon Insurance Company for Phase IVB Earthwork, Roadway, Drainage in the amount of $937,187.10.
7.  Authorize the County Administrator to accept and execute Surety Bond No. 1153387 from Lexon Insurance Company for Phase IVC Earthwork, Roadway, Drainage in the amount of $712,328.50.
8.  Authorize the County Administrator to accept and execute Surety Bond No. SNN4007859 from Nationwide Mutual Insurance Company for Common Area Landscaping/Wetland Buffer Plantings and Signs in the amount of $84,468.78.


Enabling/Regulating Authority
  • MANATEE COUNTY LAND DEVELOPMENT CODE ORDINANCE 15-17, AS AMENDED
  • MANATEE COUNTY COMPREHENSIVE PLAN, FUTURE LAND USE ELEMENT GOAL 2.4, ADEQUATE PUBLIC FACILITIES IN ALL DEVELOPED OR DEVELOPING AREAS.  The project has been issued a Certificate of Level of Service for Potable Water, Solid Waste, Sanitary Sewer, Transit, Dainage, Traffic and Fire Protection, Objective 2.4.2. Concurrency - CLOS-14-001.


Background Discussion
  • The plat for Phase IVB and IVC Del Tierra, a private single-family subdivision consisting of a total of 109 single family lots.
  • The applicant has elected to plat the subdivision prior to its construction; as a result, the applicant has provided a performance bond for plating purpose for all future private and public infrastructure improvements.  Upon completion of this subdivision and issuance of a Certificate of Completion for the subdivision by Manatee County, the performance bond will be released and replace3d with a defect security bond.  At the same time the applicant shall execute the requirement agreement(s) and a Bill of Sale and submit both to Manatee County for execution and acceptance.
  • All common areas will be maintained by the Del Tierra Homeowners' Association, Inc.
