Florida Department of Transportation Construction Agreements for Utility Relocations - Water, Sewer, and IT Communications / School Board at SR 64 and Rye Road

The Florida Department of Transportation (FDOT) and Manatee County desire to enter into the agreement pursuant to Sections 334.0044 (13) and 339.282, Florida Statutes, to construct and improve public transportation facilities.
The County often enters into Florida Department of Transportation (FDOT) Agreements required as a condition of having County utilities present in the FDOT Rights-of-Ways that require adjustments to accommodate FDOT facilities.
The FDOT is currently undertaking improvements to the intersection of SR 64 at Rye Road. As a result, it is desirable to Manatee County for the FDOT contractor to perform the relocation of the County utilities including water and sewer. Also during the performance of this scope of work, it is desirable for the FDOT contractor to relocate the IT communications for the School Board and the County.
By entering into these agreements, the FDOT contractor will relocate both the County and IT/School Board utilities. The cost for the relocation is the County's responsibility and is as follows:
A three party escrow agreement will need to be executed by the Chairperson for the Water and Sewer Relocates because the cost of relocation needs to be funded by Manatee County. Manatee County will deposit the funds into the escrow account prior to the FDOT advertising for bidding which is estimated for March, 2018. Based upon that advertising date, funds will need to be deposited in February 2018. The School Board will reimburse the County $32,544.21 for that portion of relocation.

These agreements are formatted the same as recent documents signed by the Board for the improvements by the FDOT currently under construction at the interchanges of SR 64 and I-75, and SR 70 and I-75, except these agreements do not have Federal participation and will require the County and School Board to pay for the relocation.
Those similar agreements were reviewed by the County Attorney's Office. Please refer to RLS No. 15-301; CAO File No.9001-39.
