Action Requested

Authorize the Chairperson to execute Resolution 16-170 authorizing an exchange of County property per Florida Statute (F.S.) 125.37; providing an effective date.

Authorize the Chairperson to execute an Exchange of Property Agreement to release 2.82 acres of County owned land to LWR Land Holdings, Limited Liability Company (LLC), in exchange for a non-exclusive permanent easement.

Authorize the Chairperson to execute a Deed to release 2.82 acres of County owned land to LWR Land Holdings, LLC.

Authorize the Chairperson to execute a Non-Exclusive Permanent Easement for access and maintenance of surface and/or underground drainage and utility facilities.

Background Discussion
  • The County acquired ownership of the 2.82 acres of land associated with the existing stormwater retention pond (Pond #7) along the Right-of-Way (ROW) of Lakewood Ranch Boulevard to provide water quality treatment and attenuation of runoff for a portion of the roadway between State Road 64 (S.R. 64) and State Road 70 (S.R. 70).

 

  • The County is presently responsible for maintenance and re-certification of the existing stormwater retention pond.  This existing stormwater retention pond is included within a warrantee deed (Official Record (O.R.) Book 1540, Pages 7900-7910).

 

  • LWR Land Holdings, LLC, is proposing to construct a light-industrial warehouse facility on adjacent property.  LWR Land Holdings, LLC has approached County staff to enter into a land exchange in order to relocate the existing retention pond.

 

  • LWR Land Holdings, LLC, in coordination with staff, has crafted the subject Resolution, Exchange of Property Agreement, Deed and Non-Exclusive Permanent Easement to relocate the County stormwater retention pond.

 

  • The County would release 2.82 acres associated with the existing retention pond to LWR Land Holdings, LLC. 

 

  • In exchange, LWR Land Holdings, LLC would dedicate to the County a Non-Exclusive Permanent Easement for access and maintenance of surface and/or underground drainage and utility facilities associated with the relocated retention pond.

 

  • LWR Land Holdings, LLC, would be responsible for the cost associated with design, permitting, and construction of the relocated stormwater retention pond, conveyance systems, and outfall systems. 

 

  • The relocated retention pond would serve water quality treatment and attenuation of runoff combined from Lakewood Ranch Boulevard and the light industrial warehouse facility.

 

  • Future maintenance and certification of the relocated retention pond, conveyance, and outfall system will be the responsibility of LWR Land Holdings, LLC, through Southwest Florida Water Management District (SWFWMD) Environmental Resource Permitting (ERP).

Separate original, signed copies of the Resolution, Exchange Agreement, Deed, and Easement, shall be made available for pick-up by LWR Land Holdings, LLC.

N/A. All cost associated with design, permitting, and construction of the relocated stormwater facility and conveyance/outfall systems shall be borne by the LWR Land Holdings, LLC. In addition, the Developer is not seeking impact fee credits.
