Motion to adopt Resolution 15-190
Florida Statutes Sec. 125.01
At its meeting of October 20, 2015, the County Commission instructed the County Attorney’s Office to develop a resolution clarifying the process to be used whenever it is determined either by the County’s administration, or the County Attorney’s Office, that a current member of a County advisory board or commission has become disqualified to hold the office.
Generally stated, the Commission wanted to ensure that where there has been such a determination, the member be treated with respect and dignity when notified, and that no notification be made until the Chair of the Commission has been afforded the opportunity to understand the related facts and to personally inform the member. The Commission also wished to ensure that each Commissioner receive contemporaneous notice when such a notification is made, and that only the Commission has the right to remove a current and otherwise qualified advisory board or commission member.
Pursuant to the Board's direction, the County Attorney's Office has drafted Resolution 15-190 providing for the terms outlined by the Commission at its meeting. The Resolution has been approved by the County Attorney and is otherwise in sufficient form to allow for Board consideration.
