Action Requested

Motion to reduce the fine for case number CE2016040230 totaling $20,550.00 to $2,000.00 (as previously recommended by the Special Magistrate on July 26, 2017), subject to the following conditions:

  1. The reduced fine shall be paid within 90 days or will revert back to the original fine amount of $20,550.00 for case number CE2016040230.
  2. Building and Development Services Department Director is authorized to sign satisfactions of liens if reduced fines are paid.

Background Discussion

William Mitchell (previous owner) had a vacant home and failed to remedy violations.  Investway Group of Florida Corp. purchased the property on February 24, 2017, for investment purposes.

The new property owner indicated that he spent $2,500 to abate the violations, which included the purchase of a new garage door, windows for the whole house, and new doors to the front and back.  All trash and debris has been removed as well.

  1. Violation:  Section 2-9-106(c) Structural standards. Vacant home was open and accessible.
  2. Notice of Violation was issued on April 12, 2016
  3. Special Magistrate Hearing was on July 27, 2016 - order to comply on or before August 10, 2016, or a fine of $75 shall be imposed against the Respondent for each day the violation has continued past the compliance date ordered.
  4. Compliance date was May 12, 2017
  5. Fines for the case total $20,550.00 to settle the case.
  6. Special Magistrate Mitigation hearing was held July 26, 2017.  The Magistrate determined that justification exists to reduce the total fine amount and to forward the request to the Board of County Commissioners with a recommendation to reduce the fine amount totaling $20,550.00 to $2,000.00 to settle the case.  Staff recommends approval.
