Action Requested

RECOMMENDED MOTION:

Based upon the staff report, evidence presented, comments made at the Public Hearing, the action of the Planning Commission, and finding the request to be CONSISTENT with the Manatee County Comprehensive Plan and the Manatee County Land Development Code, as conditioned herein, I move to ADOPT Manatee County Zoning Ordinance No. PDR-12-12(Z)(P); APPROVE the Preliminary Site Plan with Stipulations #A.1-A.6, B.1 & B.2, C.1, D.1, E.1-E.5, and F.1; GRANT Special Approval for a project with a gross density of greater than 1 du per acre in the UF-3 (Urban Fringe) Future Land Use Category; and ADOPT the Findings for Specific Approval and GRANT Specific Approval for an alternative to Section 714.8.7 of the Land Development Code to allow the installation of smaller diameter trees, as recommended by the Planning Commission.

Background Discussion
  • Extended Investments Holdings, LLC (Southern Oaks) has filed a rezone application from “A/NCO” (Agriculture/North Central Overlay) to “PDR/NCO” (Planned Development Residential/North Central Overlay) and an accompanying Preliminary Site Plan.  The 70.70 acre site is west of North Rye Road and approximately 2 miles south of S.R. 675.  The application is proposing 139 dwelling units on the subject property.

 

  • The site is designated UF-3 (Urban Fringe) on the Future Land Use Map; the total number of dwelling units proposed (139) is lower than the maximum number of dwelling units permitted (212) in the Urban Fringe FLU category

 

  • The staff report includes an analysis of consistency of the application with the North Central Overlay to ensure the transition from rural and agricultural uses to low and moderate density residential developments that will include higher design standards for landscaping, buffering and setbacks.

 

  •  The applicant is requesting Special Approval to allow a project with a gross density of greater than 1 du per acre in the Urban Fringe FLU category as well as Specific Approval to allow an alternative to Section 714.8.7 of the Land Development Code to allow the installation of smaller diameter trees.

 

  • The site is in an “X” Flood Zone, and in the Gamble Creek Watershed Study.

 

  • Water and Sanitary Sewer will be provided. 

 

  • Staff recommends approval with stipulations. 

 

  • On March 14, 2013 by a vote of 6 – 0, the Planning Commissioner recommended approval.
