RECOMMENDED MOTION:

Based upon the staff report, evidence presented, comments made at the Public Hearing, the action of the Planning Commission, and finding the request to be CONSISTENT with the Manatee County Comprehensive Plan and the Manatee County Land Development Code, as conditioned herein, I move to ADOPT Manatee County Zoning Ordinance No. PDR-05-53(P)(R); amending and restating Ordinance No. PDR-05-53(P); and APPROVE the Revised Preliminary Site Plan [PDR-05-53(P)(R)] with Stipulations #1-13; GRANT Special Approval for a project: 1) exceeding a gross density of one dwelling unit per acre in the UF-3 Future Land Use Category, 2) exceeding a net density of three dwelling units per acre in the UF-3 Future Land Use Category, and 3) with habitable structures within the 25-year floodplain; ADOPT the Findings for Specific Approval; and GRANT Specific Approval for alternatives to Sections 603.7.4.1, 702.6.7, 714.8.7, 715.3.4, 718.6 and 740.2.6.11 of the Land Development Code, as recommended by the Planning Commission.

Background Discussion
  • The 18.00± acre site is approximately two miles north of SR 64 on the south side of Upper Manatee River Road, approximately ½ mile east of the curve at 11708, 11710 and 11718 Upper Manatee River Road, Bradenton.

 

  • The site is in the UF-3 Future Land Use Category (FLUC) and has been zoned PDR (Planned Development Residential) since the adoption of the 1990 Land Development Code. 

 

  • On 10/02/06, the Board of County Commissioners approved a Preliminary Site Plan for 31 lots for single-family detached residences.  Since that time, a Final Site Plan (PDR-05-53/FSP-07-28) was approved administratively.  The Final Site Plan will expire on 03/16/2015. 

 

  • The current request is to revise the Preliminary Site Plan to add seven more lots (total number = 38-lots) for single-family detached residences.  

 

  •  A gross density of 2.1 dwelling units per acre is consistent with the UF-3 FLUC.  Special Approval is required for a density exceeding one dwelling unit per acre.  Special Approval may be granted through the planned development process. 

 

  • Since the 2012 Coastal maps have been implemented, the site is no longer in the  Coastal Evacuation Area (CEA), and Coastal High Hazard Overlay District (CHHA).   However, the map indicates the site is in the Coastal Planning Area (CPA).  

 

  • The site plan shows one access point connecting Upper Manatee River Road.  The applicant requests Specific Approval to allow the proposed internal roadway to have a transition to match the existing grade of Upper Manatee River Road.  Other Specific Approval requests include: a reduced pavement width, a reduced agricultural buffer width, reduced roadway buffer width, smaller replacement tree sizes, and one canopy tree per lot rather than planted every 50 feet.

 

  • There are 0.18± acres of wetlands and no wetland impacts.  No historic structures, archaeological sites, or artifacts were found within the project area.

 

  • Staff recommends approval subject to the recommended stipulations.

 

  • On March 14, 2013, by a vote of 5 – 0, the Planning Commission recommended approval. A summary of the public comments from that hearing are in the staff report attached to this memo.
