Action Requested

Motion to reduce the fines for this case to $3,500.00 (as previously recommended by the Special Magistrate on March 23, 2016), subject to the following conditions:

  1. The reduced fines shall be paid within 90 days or will revert back to the original fine amount of $76,250.00 for CE2011070033.
  2. Recording fees need to be collected, which total $20.00.
  3. Building and Development Services Department Director is authorized to sign satisfactions of liens if the reduced fines are paid.

Background Discussion

Code Enforcement Case CE2011070033, 5835 13th Street Court East, Bradenton, FL. 34203. (PID #5819100008). Below is a brief synopsis regarding this case:

  1. Violation: Agricultural animals (including but not limited to chickens and roosters) were on the property.
  2. Notice of Violation issued 7/11/2011.
  3. Special Magistrate Hearing 8/24/2011. Ordered to comply by 9/23/2011 for Section 704.2.2 or a $100.00 minimum fine and $50.00 per day fine would be imposed.
  4. Section 704.2.2 was complied 11/25/2015.
  5. Total fine $76,250.00 plus $20.00 recording fee.
  6. Property owner offered $3,500.00 plus $20.00 recording fee.
  7. Special Magistrate Mitigation Hearing 3/23/2016. The Magistrate determined that justification exists to reduce the total fine amount and to forward the request to the Board of County Commissioners with a recommendation to reduce the fine amount to $3,500.00 plus $20.00 recording fee.

This property sold on 7/13/2015. The previous owner advised us that the chickens and hens were removed years ago, but, never contacted us to inspect the property to stop the fines. The County passed an Ordinance on 06/04/13 permitting chickens on residentially zoned property with limitations.
