Action Requested

RECOMMENDED MOTION:

Based upon the staff report, evidence presented, comments made at the public hearing, the action of the Planning Commission, and finding the request to be CONSISTENT with the Manatee County Comprehensive Plan and the Manatee County Land Development Code, as conditioned herein, I move to ADOPT Manatee County Zoning Ordinance No. PDC-13-42(P); and APPROVE the revised Preliminary Site Plan with Stipulations A.1-A.5; B.1; C.1; D.1, E.1, and F.1-F.3; ADOPT the Findings for Specific Approval for: 1) an alternative to Land Development Code Section 714.8.7 to allow the installation of smaller diameter trees and 2) an alternative to Land Development Code Section 715.3.3 for Foundation Landscaping; as recommended by the Planning Commission.

Background Discussion

• RaceTrac. has filed a Preliminary Site Plan application for commercial development on approximately 3.54  + acres zoned PDC (Planned Development\Commercial) and located at the southeast corner of S.R. 70 and 30th Street East, to develop with 6,000 square foot convenience store, with 9 pumps (18 fueling stations) and a 10,000 square foot dispenser canopy;
• The property was previously operated as a retail plant nursery center with greenhouses, and the historic residence on-site was used as an accessory office and retail sales.
• The site is designated R/O/R (Retail/Office/Residential) on the Future Land Use Map.
• The site is in an “X” Flood Zone;
• Water and Sanitary Sewer will be provided;
• Specific Approvals has been requested for:
– Smaller diameter trees; and
– An alternative for the required Foundation Landscaping; and
• Staff recommends approval with stipulations.
• On May 8, 2014, by a vote of 5 – 0, the Planning Commission recommended approval.
• A summary of the public comment heard at the May 8, 2014 Planning Commission public
