Action Requested


Based upon the staff report, evidence presented, comments made at the Public Hearing, and finding the request to be CONSISTENT with the Manatee County Comprehensive Plan and the Manatee County Land Development Code, I move to ADOPT Manatee County Zoning Ordinance No. PDMU-06-16(P)(R6); amending and restating Ordinance No. PDMU-06-16(P)(R5); and APPROVE the Preliminary Site Plan with conditions for a project that was previously granted Special Approval: 1) in the RES-6, and MU Future Land Use Categories, and 2) in the Entranceway; and a project that was previously granted Specific Approval for alternative(s) to Sections 603.11.4.3, 702.6.10, 710.1.6,  714.8, and  702.6.8 of the Land Development Code, as recommended by staff.

Background Discussion

• The University Groves rezone and Preliminary Site Plan were approved on April 22, 2003 [(fka PDMU-02-20(Z)(P)]. The 142.15± acre project consists of a mix of residential, office, commercial and medium intensity recreational uses, and currently is approved for 732 residential units and 380,645 square feet of non-residential uses, for a maximum overall gross density of 5.26 dwelling units per acre, and a 0.23 Floor Area Ratio (FAR).
• The following amendments were previously approved for the project:

- 06/20/2006: Received approval for an extension of the CLOS and minor changes to the site plan and development entitlements [(PDMU-06-16(P)].
- 06/04/2009: Received approval for various development options relative to uses in Areas I-VI [PDMU-06-16(P)(R)].
- 06/23/2009: Received approval for setback reduction and specific approval for waterfront yard reduction in The Residences at University Groves subdivision [PDMU-06-16(P)(R2)].
- 01/07/2010: Received approval to reduce side yard setbacks for three additional lots in The Residences at University Groves subdivision [PDMU-06-16(P)(R3)].  
- 02/03/2011: Received approval to allow an option for recreational area improvements to be constructed at the Townhouse Residences at University Groves (pool and clubhouse optional amenities) [PDMU-06-16(P)(R4)].
- 08/08/2013:  Received approval to modify development options in Areas II, IV, V, VI, and Mixed-Use Area allowing more diversity of non-residential uses, and increasing commercial square footage including medium intensity recreational uses with simultaneous reduction of office space [PDMU-06-16(P)(R5)].

• The applicant requests to reduce the minimum setback along University Parkway for parking areas located west of the main entrance (south of Buildings 25A and 25B) from 110 feet to 40 feet. The proposal includes reshaping a storm water facility (southeast portion of Lake 6), removal of some trees to accommodate a new parking area (approximately 40 parking spaces), and a minor reduction of the overall open space (0.5± acres).
• Prior approved Stipulation #3.J has been revised to show the proposed setback reduction and to address tree removal, replacement and/or preservation. No other changes to the prior approved Preliminary Site Plan have been proposed at this time.
• The proposal is consistent with the Comprehensive Plan and the Land Development Code including applicable regulations for a project within the PDMU zoning district, and an Entranceway.
• Staff recommends approval of the proposed changes.
