Action Requested
  • Execution of Contract for Sale and Purchase for a Warranty Deed with Dwayne J. Davis and Ann C. Davis, for the purpose of the Ellenton Gillette Road Intersection Improvement Project (U.S. 301 at Ellenton-Gillette Road) in the amount of $121,068.37.


Enabling/Regulating Authority
Chapters 125 and 127, Florida Statutes.  Manatee County Comprehensive Plan Goal 5.1 addresses the safety and efficiency of forecasted vehicular demands.

Background Discussion
  • The Ellenton Gillette Road Intersection Improvement Project (U.S. 301 at Ellenton Gillette Road) was approved in the FY 2014-2018 CIP 381-6035161.
  • Parcel 5 is improved with single-family home that is owner occupied at 1207 36th Avenue East in Ellenton.  The project requires a partial take of 2,199 square feet.
  • On July 13, 2015, Appraiser Nicholas Chop, MAI, Florida Valuation, Inc., determined the value of the area for acquisition at $46,800.00;  Land taken $19,800.00; Improvements $1,400.00; Severance Damages at $25,600.00.
  • Dwayne J. Davis and Ann C. Davis, the homeowners, retained Michael R. Whitt, attorney with Robins Kaplan, LLP.
  • A settlement was reached at $121,068.37 which includes expert costs.
  • This settlement will eliminate eminent domain and additional litigation fees and costs.
