Action Requested
Authorization for Chairman to execute Impact Fee Credit Authorizations and Final Authorizations of Road Impact Fee Credit totaling $12,229,595.00 for fourteen (14) capital contributions (right-of-way dedications and road improvements) made by Schroeder-Manatee Ranch, Inc., and the Lakewood Ranch Stewardship District.  Per assignments authorized by these entities, execute all Credit Authorizations and Final Authorizations of Credit referenced herein on behalf of SMR North 70, LLC.

Background Discussion
As of the date of the preparation of this agenda item, two public hearings have been scheduled for a Local Development Agreement (LDA) regarding SMR North 70, LLC's Northwest Sector/Lakewood Centre DRI.

The second of the two hearings is on this November 7, 2013 Land use agenda.  This Impact Fee Credit Authorization is requested pursuant to the terms of the LDA referenced above.


Chapter 8, Section 807 of the Manatee County Land Development Code provides for authorization by the Board of County Commissioners for Impact Fee Credits for contributions, payments, construction, or dedications made to Manatee County against applicable components of impact fees assessed for future construction.  .

From April, 2004, to September, 2011, Schroeder-Manatee Ranch, Inc. (SMR) and the Lakewood Ranch Stewardship District (LWRSD) made 14 capital contributions, involving land dedication and road construction/improvements, that increased the capacity of major thoroughfares in southeastern Manatee County.  Rather than applying for impact fee credits as these dedications/improvements were made, SMR made one large submission for credit in June, 2011.  As there is no expiration of eligibility for impact fee credit once a developer has made a capital improvement to County infrastructure, staff has reviewed the entire submission and determined what it believes is the total value of road impact fee credit to which SMR is entitled.  

In addition to approval of the requested road impact fee credits, SMR and LWRSD are requesting that all of these credits be assigned to SMR North 70, LLC.  As part of the Northwest Sector/Lakewood Centre Local Development Agreement being presented and considered later in this meeting, the use and disposition of these credits will be discussed in greater detail.
