Action Requested
ADOPT Resolution R-13-192.

Enabling/Regulating Authority

Land Development Code:  Chapter 9, Section 911.3, Public Hearing Requirements for Vacation of Streets, Roads and Other Appropriate Property. 

Florida Statutes: Chapter 177, Section 177.101 (3),  Vacation and Annulment of Plats Subdividing Land, and Chapter 336, Sections 336.09, et seq., Closing and Abandonment of Roads.



Background Discussion

On October 22, 2013, Resolution R-13-191, Regular Meeting Agenda Item #45 was approved in Open Session by the BCC.

Carole Lynn Marler is requesting a portion of a 30 foot platted unimproved right-of-way be vacated. It is described as a portion of Tamiami Farms Subdivision, Plat Book 5, Page 9, located east of Erie Road between Erie Lane and Erie Court in Parrish, and bisects through PID 741710008. 

The applicant desires to consolidate her tracts into one property by removing the platted right-of-way separating two of her tracts of land.

Jurisdictional Review by appropriate County Departments and Private Utility Agencies are approved without any objection. This vacation would serve only the applicants and complies with the technical requirements of the County's Land Development Code and pertinent Florida Statutes.

All application process expenses will be paid by the Applicant.  The application filing fee of $800 was paid by the Applicant on January 15, 2013.
