Proposed Motion: (for Denial)

I move to adopt Resolution No. R-17-077 to deny Preliminary Site Plan Application No. PDMU-16-02(P) inclusive of all related requests for Special Approvals, Specific Approvals and Specific Findings for the requested additional height above 35 feet for four proposed buildings.

Land Development Code (the version of the LDC in effect prior to the date of adoption by the Board of proposed Ordinance No. 17-22)

 



Background Discussion
  • The Board held a duly noticed public hearing on Preliminary Site Plan Application No. PDMU-16-02(P) along with the accompanying applications for Special Approval and Specific Approval on June 1, 2017 (with such hearing being continued to enable the resolution of a pending legal challenge to August 3, 2017, September 7, 2017, October 5, 2017 and November 2, 2017).
  • The Board passed a motion on June 1, 2017 to continue the deliberation portion of the public hearing on Ordinance No. PDMU-16-02(P) to the next available Board Land Use meeting of August 3, 2017 to enable the preparation of findings to support the denial of this Preliminary Site Plan application pursuant to the Comprehensive Plan and the Land Development Code. The vote was 5 - 2 (Commissioners Jonsson and Baugh  voting no).
  • A pending legal challenge filed by the Applicants concluded with the issuance of a Final Order by the Florida Department of Economic Opportunity (FDEO) on October 16, 2017 (the appeal period is currently running).
  • Proposed Resolution No. 17-077 is for action by the Board to deny Preliminary Site Plan Application No. PDMU-16-02(P) inclusive of all related Special Approvals and Specific Approvals and sets forth the applicable Findings of Fact and Conclusions of Law.
