FORM OF MOTION:

  1. Approval of, authorization for Chairman to execute, and authorization to record Final Subdivision Plat;
  2. Acceptance of, and authorization to record Lot Drainage and Grading Plans;
  3. Acceptance of, authorization for Chairman to execute, and authorization to record Mortgagee's Joinder in Declaration only from SMR NORTH 70, LLC;
  4. Acceptance of, authorization for Chairman to execute, and authorization to record Consent to Subdivision Plat and All Dedications and Reservations Thereon from Lakewood Ranch Stewardship District;
  5. Acceptance of, authorization for Chairman to execute and authorization to record Agreement for the Installation and Maintenance of Publicly Owned Facilities Underlying Privately Owned and Maintained Developments (POMD);
  6. Acceptance of, and authorization for Chairman to execute Required Improvements Agreement and Temporary Construction Easement for Private Improvements; Re:  Surety Bond No. 1091858 from Lexon Insurance Company;

Enabling/Regulating Authority
  • Manatee County Land Development Code, Ordinance 90-01, As Amended.
  • Future Land Use Element Goal 2.4, Adequate Public Facilities in all Developed or Developing Areas.  The Developer has been issued a Certificate of Level of Service for Potable, Solid Waste, Sanitary Sewer, Transit, Drainage, Traffic and Fire Protection, Objective 2.4.2, Concurrency.  The development was issued CLOS #07-093.


Background Discussion
  1. This is a single-family private subdivision with 102 lots.
  2. The Developer has posted performance bonds for the remaining public and private required improvements.
  3. The common areas will be maintained by the Esplanade Community Association or the Lakewood Ranch Stewardship District.
  4. The required utilities will be maintained by the County when they are dedicated.
