Action Requested

Motion to Dismiss the remaining fines for this case in the amount of $347,881.33 ($18,318.67 in surplus tax funds were received on 12/7/2015 and applied towards this case) and (as previously recommended by the Special Magistrate on May 25, 2016), subject to the following conditions:

  1. Recording fees of $40.00 will be waived.
  2. Building and Development Services Department Director is authorized to sign the satisfaction of lien.

Background Discussion

Code Enforcement Case CE2008070167, 3519 20th St E, Bradenton, FL. 34208 (PI #1583000003).  Below is a brief synopsis regarding this case:

  1. Violation:  Porch enclosed without the required building permit and certificate of occupancy.
  2. Notice of Violation issued 7/17/2008.
  3. Special Magistrate Hearing 11/25/2009. Ordered to comply by 12/23/2009 for Section 512 or a $150.00 minimum fine and $100.00 per day fine would be imposed; and ordered to comply by 5/21/2010 for Section 513 or a $150.00 minimum fine and $100.00 per day fine would be imposed.
  4. Sections 512 & 513 were both complied 3/12/2015.  
  5. Total fine balance remaining $347,881.33.00 plus $40.00 recording fee.
  6. Property owner has requested that the County accept the surplus tax funds that were received on 12/7/2015 in the amount of $18,318.67 as payment in full for the outstanding fines.
  7. Special Magistrate Mitigation Hearing 5/25/2016. The Magistrate determined that justification exists to reduce the total fine amount to payment received and to forward the request to the Board of County Commissioners with a recommendation to accept the amount received and to order the liens to be satisfied.

 This property was sold at Tax Deed Sale.

11/17/2014 Tax Deed was awarded to the new owner.  $18,318.67 from surplus tax deed sale was received by Code Enforcement toward the outstanding fines on this property. The new owner worked on the property over five (5) months after purchasing it and paid out approximately $3,000.00 to bring the property into compliance.
