RECOMMENDED MOTION:
 
Based upon the staff report, evidence presented, comments made at the Public Hearing, and finding the request to be CONSISTENT with the Manatee County Comprehensive Plan and the Manatee County Land Development Code, I move to ADOPT Manatee County Zoning Ordinance No. PDC-87-01(P)(R5) to extend the Preliminary Site Plan for two (2) years from April 2, 2016 to April 2, 2018, as recommended by staff.

Background Discussion


• Kirsten Baier, Esq. – Fowler White Burnett PA, agent for the owner, is requesting an extension of the expiration date for a period of two (2) years from April 2, 2016 to April 2, 2018 for a Preliminary Site Plan.

• The Burger King restaurant, located on Parcel 1A, commenced operations in October 2009; however, Parcel 1B remains undeveloped.

• The property is the last remaining undeveloped parcel in the Ranch Lake Plaza Shopping Center.

• Staff reviewed the future land use and zoning to determine if any change to adjacent properties has occurred that would render the existing PSP inconsistent and staff’s review concluded that nothing has occurred since the original PSP adoption that would render the approved PSP inconsistent.

• Staff supports the request for a two (2) year extension of the Preliminary Site Plan.
