Action Requested
ADOPT Resolution R-15-082.

Enabling/Regulating Authority
  • Manatee County Land Development Code Chapter 9, Section 911.3, Public Hearing requirements for Vacation of  Streets, Road, and other Appropriate Property.
  • Florida Statutes Sections 177.101, et seq., Vacation and Annulment of Plats Subdividing Land.


Background Discussion
  • MVP Lakewood Ranch, LLC, is requesting vacation of a 2.25 acre unimproved platted drainage easement at Lot 4 Creekwood East, a Commercial Subdivision, Plat Book 50, Page 68.
  • The Applicant submitted an amended Final Site Plan FSP-13-36 (R) on April 24, 2014, to construct a drive-thru restaurant/retail on Lots 4 and 5 of Creekwood East.  In order to complete this project, the Applicant has requested this vacation to allow for site reconfiguration and create three (3) new flowage easements on Lots 4 and 5 of Creekwood East.
  • Jurisdictional reviews by appropriate county departments and private utility companies serving the location to be vacated have been notified of the intention to file a vacation.
  • Per Public Works request, the applicant will be providing a Flowage Easement Agreement which addresses the concerns noted by the Public Works Department during the Jurisdictional review process.  This will be presented on July 28, 2015.
  • The vacation complies with the technical requirements of the Manatee County Land Development Code and pertinent Florida Statutes.
  • All expenses associated with the subject vacation will be paid by the applicant.
  • Manatee County's application fee of $800 has been paid.
