Background Discussion

On Saturday, August 2, 2014, Manatee County Utility staff was notified of a failure at Mirror Lake Lift Station RTU 107, Mirror Lake Condominiums, located at 3795 59th Avenue West, Bradenton, FL, 34209. 

Specifically, at approximately 5:00 PM, the Lift Station on-call supervisor, Earl Wilson, received notice from Sewer Collections that the lift station was not functioning and that some of the condominiums were backing up with raw sewage. After bringing the lift station back online, staff began investigating the extent of  damage to the four units they could gain entry to. Unfortunately, after investigating the four accessible units it was determined that all had suffered extensive raw sewage damage.

It was later determined that two buildings, H & J, sustained sewage backups and that potentially eight total units had been affected. Utilities staff then notified Ray Carter, the former Manatee County Risk Manager, of the situation who then instructed staff to continue investigating the extent of the damage. Eventually, with the assistance of Mirror Lake maintenance personnel and members of the homeowners' association (HOA), a total of eight units were identified as having sustained damage. Efforts were quickly made by homeowners and the HOA  for emergency contractors, Accutech and Serve-Pro, to respond Saturday evening.

On Monday, August 4,2014, Utilities' personnel determined that on the evening of Friday, August 1, 2014, lightning had struck the lift station. Further, it was determined that the Radio Interface Module (RIM) was undamaged and continued to transmit that there was no 'status change' indicating that the station was operating normally. However, unbeknownst to staff, the strike had destroyed key components of the lift station. From approximately 9:00 PM Friday until late Saturday afternoon,raw sewage from Mirror Lake was backing up into the collection system for 26 buildings each with 8 units; four upstairs and four downstairs. The two buildings affected, H & J, were built at the lowest elevation within the complex.  When the collection system became full, the sewage flowed back into the downstairs' units of  buildings H & J until the lift station came back online.

The total approved settlement allowance for the original agenda item brought before the Board on October 7, 2014, was $187,000, which included remediation, restoration, and other associated costs to the homeowners and/or renters. Seven of the eight affected condominium units have been successfully restored to prior loss condition. The negotiated settlement as to the sole remaining unit will cause the aggregate of all settlements to exceed the original approved amount by $6,786.13.
