Background Discussion

The Developer is the owner of certain real property located in Manatee County, Florida, in Section 32, Township 33 South, Range 18 East and in Section 5, Township 34 South, Range 18 East.   The Developer has submitted to the County a plan for a residential community on the property, which is identified as PDR-14-04(Z)(P)/14-S-72(P)/FSP-14-57 and which is known as "Willow Walk, Phase 1" (The "Project").   The Developer desires to connect the Project to the County's wastewater collection/conveyance system for the benefit of the Project.  Pursuant to the County's request, the Utility Improvements depicted in the Scope of Work will exceed the capacity required by the proposed Project.

The proposed sewer forcemain will cross the Florida Power and Light (FPL) Railroad Right-of-Way, and will benefit the Developer and the Manatee County Utility system.  The attached FPL Railroad Easement Agreements for Willow Walk Phase I Utilities allows the construction of the wastewater collection/conveyance system to move forward.  The proposed easement and its sewer forcemain will become Manatee County's infrastructure  and asset upon installation.  Therefore by executing this agreement the County agrees to acquire the easement for the Utility Improvements and acknowledges that the Developer shall design, engineer, permit, and construct the Utility Improvements within the easement in accordance with the Scope of Work described in the separate participation agreement.

In general, all utilities crossing and/or accessing FPL or CSX Railroads Right-of-Way require a liability insurance policy in the amount of $3,000,000 with FPL shown as the Loss-Payee on the policy.  The annual estimated premium for this policy is $1,400.00.
