Approval and execution of Assignment of Right-of-Way Maintenance Agreement with Willow Walk Community Development District & Willow Walk Community Association, Inc.
Florida State Statute 336.002 and 336.008 and Board of County Commissioners Resolution 01-96
The final plat for Willow Walk Phase 1A was approved by the Board of County Commissioners on August 25, 2015. Included in that process was a Right-of-Way (ROW) maintenance agreement with the Willow Walk Community Association for the maintenance of a median island in the County ROW at one of their entrances. Since then, the overlapping Willow Walk Community Development District (CDD) has requested taking over the maintenance from the HOA. County staff is supportive of the assignment of maintenance responsibilities from the Home Owners Association (HOA) to the CDD because of the better financial position of a CDD in collecting fees/dues for such maintenance.
Attached is a copy of the referenced letter requesting the maintenance be taken over by the CDD and the document assigning the maintenance from the HOA to the CDD.
