Background Discussion

The Public Works Department received a request from the Preserve at Panther Ridge Home Owners Association to maintain their existing decorative traffic sign supports within their development. See attached Exhibit A for list of roadways and typical decorative traffic signs.

The Public Works Department maintains and repairs traffic signs along all County maintained Right-of-Way (ROW) to meet state and local requirements and to ensure compliance with Manual on Uniform Traffic Control Devices (MUTCD) standard for size, placement, and retro reflectivity. The current County standard for traffic sign supports is a galvanized steel U-channel, per Manatee County Public Works.

As Right-of-Way (ROW) is turned over to the County by private development, maintenance responsibilities for common areas, landscaping, etc. are passed along to home owner groups. These developments often incorporate the use of decorative traffic sign supports; which is the case with the Preserve at Panther Ridge.

Agreements for the home owners’ associations are needed for them to maintain this nonstandard and costly infrastructure within the County ROW in order to ensure these devices and signs are maintained to MUTCD standard for size, placement, visibility, and function.

Public Works obtained assistance from the County Attorney's Office to develop this agreement to allow Preserve at Panther Ridge Home Owners Association to:

  1. Retain the existing decorative traffic sign supports as identified in Exhibit A.
  2. Identify the specific roadways and signs which will be maintained.
  3. Identify maintenance requirements by other entities within County ROW.

The County has the option to remove the decorative infrastructure if the signs are not properly maintained and replace them with standard sign supports. 

Public Works has worked with the County Attorney's Office and the Preserve at Panther Ridge Home Owners Association to draft an acceptable agreement and we are requesting approval and execution of the agreement.

Public Works Department proposes to execute the attached "Maintenance Agreement for Traffic Signs and Decorative Supports" with the Preserve at Panther Ridge Home Owners Association for the community to maintain the existing decorative traffic sign supports with attached signs.
