The legal authority for this item is FS 125.38 and Manatee County Local Laws, Ch. 1-1, Art.II., Div. 3 Subsection 1-1-48.
The property known as the Manatee County Fairgrounds located at 1303 17th Street West in Palmetto consists of approximately 30 acres assembled in parcels beginning in 1949 when the City of Palmetto and Manatee County Government conducted a land trade involving the initial 20 acre parcel. In 1950, the Manatee County Board of County Commissioners approved the construction of the first building. Since that date the property has been developed in partnership. Many of the buildings were constructed with funds from the Manatee River Fair Association (MRFA), Manatee County Government, Agriculture entities such as the Cattlemen's and Dairy Associations, and some state dollars were obtained.
Over the years land transferred from the MRFA to the county as recent as 1976 involving 5.5 acres. MRFA and Manatee County Government have worked together to leverage resources to maximize the opportunities for securing the adjacent properties and to provide facilities at this location; such as securing the SCL Railroad Property in 1992, purchasing excess property from the state in 1997, and building the arena in 1998.
The transfer of property ownership involves only the South end which has been under the year-round lease agreement since 2000 (see attached map). It includes the parcel transferred to Manatee County in 1976 and reduces the costs of maintenance and liability exposure incurred by Manatee County while allowing the MRFA to better plan and prepare for the future. At the same time, the reciprocal use agreement allows for a continued partnership and shared use of the grounds, buildings, and other resources.
The purchase price of $8,400 represents an amount agreed to by the MRFA as their share of a gate access improvement that was done by the County. There is no other monetary consideration for the property transfer.
Section 4.3 of the agreement has a clause that has the property revert to the County if it is not used for intended purposes, however, in item 2. of this section it provides that if the Florida Legislature repeals Section 1-1-48 of Laws of Fla.(1955) Ch. 30961, 3, this right to repossess the property shall automatically extinguish.
