Motion to approve publication and to set hearing on proposed Ordinance No. 13-49 relating to the regulation of Secondhand Goods Dealers.
Section 125.01 and Chapter 538, Florida Statutes.
The Manatee County Sheriff's Office (MSO) has requested that the County Attorney's Office review and revise a proposed ordinance which deals with the requirements that secondhand goods dealers must comply with when transacting sales. Under the current statute, secondhand goods dealers have no waiting period to comply with before reselling an item. The MSO suggests adding language that (1) will require a secondhand goods dealer to maintain physical possession on the registered premises throughout the hold period, and (2) will require the dealer to retain the item for a period of 30 days to allow the MSO to conduct a proper investigation into whether an item may be stolen.
The proposed ordinance incorporates the MSO's suggested language and is an entirely new ordinance that would be incorporated into the Manatee County Code of Laws. A summary of the ordinance will be included with the agenda package for the public hearing on the ordinance.
