Enabling/Regulating Authority

The State of Florida Department of Transportation (FDOT)  has jurisdiction over and maintains State Road 43 (US301) as part of the State Highway System.

Background Discussion
  • Manatee County entered into a Utility Design by FDOT Consultant Agreement (at Utility Expense) on July 10, 2013, to provide the design component for the removal, relocation, and adjustment of  underground Utilities that may be affected by the roadway improvements undertaken by FDOT.
  • Manatee County entered into a Utility Work by Highway Contractor Agreement (at Utility Expense) on November 6, 2014, with FDOT for the removal, relocation, protection, and/or adjustment of County Utilities under the section of roadway being constructed or reconstructed by FDOT.
  • FDOT agrees to install landscape development and signage improvements within the unpaved areas within the right-of-way of State Road 43 (US301) from County Road 675 to Moccasin Wallow Road; and Manatee County is willing to maintain such improvements after installation.  It is in the best interests of the County to approve and authorize an agreement to establish the mutual rights and obligations of the County and FDOT with respect to landscape maintenance and signage installation and maintenance.
  • Attached is the final agreement for landscape maintenance and signage installation and maintenance between the County and FDOT.
  • The landscaping is planned to be installed in one to two years following the road widening project under a separate construction contract.
