Action Requested

Motion to reduce the fines for this case to $1,200.00 (as previously recommended by the Special Magistrate on January 23, 2013), subject to the following conditions:

1.  The reduced fines shall be paid within 30 days or will revert back to the original fine amount of $11,975.00 for CE2006050534.

2.  Recording fees need to be collected, which total $20.00.

3.  Building and Development Services Department Director is authorized to sign satisfactions of liens if the reduced fines are paid.

Background Discussion

Below is a summary of Code Enforcement Case No. CE2006050534 against Frederick J. Sobr and Twenty Four Twelve LLC (fka Norman Earl White II) regarding property located at 3014 39th Avenue West, Bradenton (DP#5047600001):

  • May 23, 2006, Code Enforcement received an anonymous complaint regarding junk vehicles and fencing that was falling down on the property.
  • May 30, 2006, the zone officer cited the property owner for numerous junk vehicles with no tags and/or that appeared inoperable and for miscellaneous trash and debris items in violation of Section 703.2.23 (Parking or Storage of Junk Vehicles or Refuse Prohibited) of the Manatee County Land Development Code.
  • May 31, 2006, a Letter of Violation was sent out certified mail to the property owner and the green card returned June 6, 2006, signed by K. Giaume.
  • July 3, 2006, the zone officer did a re-investigation and found junk vehicles and trash and debris remained on the property and scheduled this case to go before the July 26, 2006, Special Magistrate hearing.
  • July 26, 2006, the Special Magistrate found in violation of Section 703.2.23 and gave a compliance date of September 22, 2006, or a minimum fine of $75 and a daily fine of $70 would be imposed.
  • September 26, 2006, the zone officer did a re-inspection and found a junk vehicle and trash and debris remained on the property and completed an Affidavit of Non-Compliance to start the fines as ordered.
  • November 17, 2006, the junk vehicle was gone but trash and debris remained and fines continued to run.
  • March 12, 2007, the zone officer did another re-inspection and found the property in compliance and stopped the fines as of that date. The fines totaled $11,975.00.
  • May 25, 2007, staff received a letter from Mr. White asking about a possible fine reduction. This case was then placed on the June 27, 2007, Special Magistrate Old Business.
  • June 27, 2007, this case was never heard due to no one showing up for the hearing.
  • November 11, 2012, Code Enforcement received a letter from Fred Sobr, the new property owner, asking for a possible fine reduction. This case was then placed on January 23, 2013, Special Magistrate Old Business with an offer to reduce to $1,200.00.
  • January 23, 2013, the Special Magistrate found justification existed for this case to be referred to the Board of County Commissioners for a recommended fine reduction to $1,200.00, which staff supported.
