Background Discussion

BACKGROUND: The Manatee County Parks and Recreation Department would like to initiate an application to vacate a portion of an improved right of way of Fort Hamer Road at the Rowing Center, located between River Isle Run and the Manatee River, containing 70,000 square feet more or less. The right-of-way was granted and recorded in O.R. Book 225, Page 680, and O.R. Book 1351, Page 2489, of the Public Records of Manatee County, Florida. This Vacation does not impact the Fort Hamer Bridge. The vacating area is approximately 500 feet west of the future Fort Hamer Bridge.


PURPOSE OF REQUEST: The Parks and Recreation Department would like to vacate the Fort Hamer Road, located within the perimeter of the Rowing Center. This request is required by Chapter 316.204, Florida Statutes, Obstruction of public streets, highways, and roads, prior to the planned repair and replacement of perimeter fencing which will include automated gates at all access points. Included within the scope of the perimeter fence project are automated access gates which will be equipped with frequency receivers allowing emergency vehicles automated access to the facility after hours when gates are closed. Additional fob type transmitters will be available for those requiring frequent access to the park after normal working hours. This will enhance the security for this facility.


COUNTY AND UTILITY COMPANY REVIEW: Jurisdictional review by other appropriate County Departments and Private Utility Companies serving the location to be vacated have been notified of the applicant's intention to file a vacation, and have no objection, and complies with the technical requirements of the County’s Land Development Code and pertinent Florida Statutes.

FISCAL IMPACT: All expenses associated with the subject application, its approval, and recording will be borne by the Applicants. Since this is a County initiated vacation request there is no application fee.
