Action Requested

RECOMMENDED MOTION:

Based upon the staff report, evidence presented, comments made at the Public Hearing, the action of the Planning Commission, and finding the request to be CONSISTENT with the Manatee County Comprehensive Plan and the Manatee County Land Development Code, as conditioned herein, I move to ADOPT Manatee County Ordinance No. PDR-13-28(P); APPROVE the Preliminary Site Plan with Stipulations #A.1 - A.5, B.1, C.1 & C.2, D.1 - D.7, and E.1; ADOPT the Findings of Special Approval for a development:  1) adjacent to a perennial lake or stream; 2) being placed within a portion of the CHHA (Coastal High Hazard) Overlay District; and 3) being placed within a portion of the CEA (Coastal Evacuation Area) Overlay; and ADOPT the Findings for Specific Approval for: 1) an alternative to LDC Section 714.8.7 of the Land Development Code to allow the installation of smaller diameter trees; 2) an alternative to LDC Section 715.3.4 to allow one canopy tree per lot frontage instead of one tree per 50 linear feet; 3) an alternative to LDC Sections 712.3 and 740.2.6.17 to allow primary access to be provided to certain lots from a 20’ wide alleyway; and 4) an alternative to the width of an alley; as recommended by Planning Commission.

Background Discussion
  • The subject property contains 61.75 + acres located southwesterly of El Conquistador Parkway and approximately 1.75 miles west of 34th Street West in Bradenton.
  • The property is designated RES-9 on the Future Land Use Map.
  • The property is zoned PDR (Planned Development Residential) and a Preliminary Site Plan for 200 single family detached lots is being considered.
  • The 200 single family detached units equates to a gross density of 3.24 du/acre and a net density of 3.30 du/acre.
  • There is a provision of 34.49% open space and 2.79 acres + of recreational area.
  • Two access points to El Conquistador Parkway are anticipated.
  • The site is in an “A-15” Flood Zone.
  • Water and Sanitary Sewer will be provided and are located on El Conquistador Parkway.
  • Specific Approvals have been requested:
    •  To allow installation of smaller trees;
    • To allow installation of one canopy tree per lot frontage instead of one tree per linear feet
    • To allow primary access to certain lots from an alleyway; and
    • To allow a 20’ wide alleyway.
  • Special Approvals have been requested:
    • To allow a development adjacent to a perennial lake or stream;
    •  To allow development within a portion of the CHHA (Coastal High Hazard Area) Overlay; and
    • To allow development within a CEA (Coastal Evacuation Area) Overlay.
  • A mutually acceptable agreement to relocate an existing pond for El Conquistador Parkway improvement into the project will also be considered by the Board of County Commissioners at the same meeting.
  • Staff recommends approval with stipulations.
  • On January 16, 2014, by a vote of 7 – 0, the Planning Commission recommended approval.
