Action Requested
  • Execution and Recording of Flowage Easement Agreement from Lakewood Ranch Senior Care, LLC, for right to access the property to maintain the free flow of stormwater drainage runoff from public right-of-way to stormwater retention facilities associated with Creekwood East Subdivision (Plat Book 50, Page 68); and
  • Accept and Record Affidavit of Ownership and Encumbrances from Mark Bouldin as Manager of Lakewood Ranch Senior Care, LLC; and
  • Record Consent from Branch Banking and Trust Company.


Enabling/Regulating Authority

Florida Statute, Chapter 125. Comprehensive Plan Goal 9.4 addresses stormwater management standards and facilities which reduce flooding and improve water quality in the county.  



Background Discussion
  • The Applicant, Lakewood Ranch Senior Care, LLC, is requesting vacation of a 25-foot drainage easement located between lots 10 and 11 of Creekwood East, Plat Book 50, Page 68 that is being presented simultaneously on this consent agenda. 
  • Subsequent to the approval of the 25 foot drainage easement vacation, Lakewood Ranch Senior Care, LLC, will replace the vacated easement with this 35-foot Flowage Easement.
  • All documents have been executed by the Applicant in order to complete its memory care facility.  
  • The Flowage Easement Agreement incorporates language from the Non-Structural Surface Improvement Affidavit and addresses the concerns noted by the Public Works Department during the jurisdictional review process. The Non-Structural Surface Improvement Intrusion Affidavit is no longer needed for this matter.
