RECOMMENDED MOTION:

Based on the staff report, evidence presented, comments made at the public hearing, and finding the request to be CONSISTENT with the Manatee County Comprehensive Plan, the Manatee County Land Development Code, Chapter 380, Florida Statutes, and subject to the conditions established in the Development Order, I move to approve the Substantial Deviation change to DRI#4 for the Wingate Creek DRI; and ADOPT Ordinance No. 13-01, as recommended by the Planning Commission.

Background Discussion
  • The request is for approval of a Substantial Deviation to the Wingate Creek Mine Development of Regional Impact (DRI) to allow:

1.)  Extend the life of mining (a.k.a. buildout and termination dates) for this DRI by 9 years to July 31, 2023;


2.)  Extend the life of reclamation for this DRI by 9 years to December 31, 2027;


3.)   Extend the expiration date of the authorized truck hauling routes by 9 years to July 31, 2023;


4.)  Amend the Development Order (DO) to allow Wingate Extension and Ft. Green remnants to be processed at the Wingate Creek Plant;


5.)  Amend the DO to allow the exchange of materials between Wingate Extension, Wingate Creek Mine, and Southeast Tract DRI;


6.)  Amend the DO to adjust the mining areas within Wingate Creek mine and to allow the mining of the Wingate / Wingate East (a.k.a: Wingate Extension and f.k.a: Texaco Tract) common property line prior setback area, the Wingate clay settling area, and remnant unmined areas;


7.)  Amend the DO to add New Wales as a destination along the previously approved haul route and restatement of prior Development Orders.

  • The Wingate Creek Mine is north of SR 64 and south of Duette Park, approximately 6 miles west of the Hardee County line.  The present zoning of the ± 3,028 acre site is EX (Extraction). 

 

  • This request is for approval to excavate and reclaim approximately 557 acres within the current mine boundaries. Only three percent (15 acres) of the 557 acres is undisturbed, of which, a ±0.6 acre isolated wetland is proposed to be impacted.

 

  • Approval of a Resolution amending the Master Mining Plan for the Wingate Creek Mine will be heard at the same hearing as the amended Development Order.

 

  • Staff recommends approval.

 

  • The Planning Commission public hearing is February 14, 2013, changes from that public hearing will be on an update memo for the February 19, 2013 Board of County Commissioners public hearing.
