Accept Affordable Housing Advisory Committee Recommendations/Report on Affordable Housing Incentives.
On April 22, 2008, Ordinance No. 08-44 was adopted by the Manatee County Board of County Commissioners regarding the establishment of the Affordable Housing Advisory Committee (AHAC) pursuant to Florida Statute 420 and Rule Chapter 67-37 of the Florida Administrative Code.
On May 6, 2008, Resolution No. R-08-045 was adopted by the Manatee County Board of County Commissioners (BOCC) appointing the eleven (11) members of the Affordable Housing Advisory Committee pursuant to Florida Statute 420.9072.
The AHAC is required to review the established policies and procedures, ordinances, land development regulations, and Manatee County's adopted comprehensive plan and make recommendations to the BOCC on specific actions or initiatives to encourage or facilitate affordable housing while protecting the ability of the property to appreciate in value.
On December 20, 2011, Manatee County Board of County Commissioners accepted the Affordable Housing Advisory Committee Recommendations/Report on Affordable Housing Incentives.
On April 10, 2012, Manatee County Board of County Commissioners adopted Resolution R-12-076 approving Manatee County's FY 2012-2015 Local Housing Assistance Plan which incorporated the expedited permitting, ongoing oversight, land bank inventory, impact fee modification, and density bonus local incentives recommended by the Affordable Housing Advisory Committee.
On May 2, 2012, the Florida Housing Finance Corporation (FHFC) Review Committee approved Manatee County's FY 2012-2015 Local Housing Assistance Plan.
On September 11, 2012, Manatee County Board of County Commissioners adopted Resolution R-09-149, amending Resolution R-12-195, providing for revisions to the Local Housing Assistance Plan (LHAP) for Fiscal Years 2012-2015.
Pursuant to FAC Rule 67-37.010(2), the AHAC is required to evaluate the established policies and procedures, ordinances, land development regulations, and Manatee County's adopted comprehensive plan and submit a report triennially on December 31st of the year preceding the submission of its Local Housing Assistance Plan.
Manatee County's Local Housing Assistance Plan (LHAP) for Fiscal Years 2015-2018 is due for submission to Florida Housing Finance Corporation for approval on May 2, 2015.
Since January 1, 2013, the AHAC has conducted one (1) meeting in 2013 and two (2) meetings in 2014. The AHAC considered each Affordable Housing Incentive as it relates to current policy and housing impact, current housing conditions, and effectiveness of each incentive as currently addressed in Chapter 13 of Manatee County's Comprehensive Plan/Housing Element and Manatee County's Land Development Code.
Recommendations were made on all incentives and the attached 2014 Incentive Review and Recommendation Report was adopted by a majority at the Public Hearing and Regular Meeting Session held on November 17, 2014, with no public comments received.
The AHAC is submitting its recommendations to the Board of County Commissioners today, and is seeking acceptance into the Board records.
The Board of County Commissioners has recently indicated they would like a worksession to be held in early 2015 to review the strategies of the plan and to discuss modification. This worksession is being set.
Pursuant to Florida Statute 420.9076, within 90 days after the date of receipt of the local housing incentive strategies recommendations from the AHAC, the Board of County Commissioners must adopt an amendment to Manatee County's Local Housing Assistance Plan to incorporate the affordable housing incentives it will implement within its jurisdictions. The amendment must include, at a minimum, the local housing incentive strategies required under F.S. 402.9071(16). The Board of County Commissioners must consider the strategies specified in paragraphs (4)(a)-(k) as recommended by the AHAC.
Through the development of the FY 2015-2018 Local Housing Assistance Plan, only those incentives which can be implemented through Manatee County's Local Housing Assistance Plan will be brought before the Board of County Commissioners in April 2015 for adoption by resolution by the Board of County Commissioners.
