Authorization for BCC to execute Contract for Sale and Purchase of a Warranty Deed from The Forum, LLC for the purchase of approximately 37.71 acres located at the northwest corner of Tallevast Road and US 301, in the amount of $4,520,000 and adoption of Budget Amendment Resolution B-13-022.

Background Discussion

The Manatee County Area Transit (MCAT) has outgrown its current facilities located at 1108 26th Avenue East.

A 37.71 acre parcel was identified as a potential site for the relocation of the current MCAT facilities while providing room for future expansion for the next twenty years.

The site is located at the Northwest corner of Tallevast Road and US 301.

A Federal Transit Administration Grant (FTA State of Good Repair Grant 5309) was secured for the development of a portion of the project.

Even though FTA grant monies will not be used for the acquisition of the real property, Manatee County had to follow the Federal acquisition standards and guidelines.  This entailed approval from FTA for the site selected.

Two independent fee appraisals and appraisal reviews were required and completed in compliance with the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, as amended, USPAP, USFLA and FTA standards.

After an exhaustive review, the FTA granted approval of the site for a Categorical Exclusion (Section 771.117D).

A Contract for Sale and Purchase for a Warranty Deed is included and recommended for approval by staff for the negotiated purchase price of $4,520,000.

Resolution B-13-022 transfers $4,700,000 from reserves previously set aside in Fleet Services Capital Projects for all costs associated with the acquisition of land for a new Trans/Fleet facility on Tallevast Road. This project and funding sources are identified in the FY 13-17 Capital Improvement Program approved by the Board on September 13, 2012.

On November 27, 2012, the BCC was briefed on the purchase of the property for the transit facility, however, Board action on the item was posponed until December 11, 2012 at the request of the FOCUS group from the Tallevast community.
