Action Requested

Approval and authorization for the Chairman to execute the Budget Amendment No.B-13-019.

Authorize the County Administrator or his designee to execute the Guaranteed Maximum Price (GMP) Addendum, for the construction phase of the Design Build Construction Services with Monitoring, Maintenance and Operation for Lena Road Gas Generator awarded to STERNS, CONRAD & SCHMIDT CONSULTING ENGINEERS, INC., dba, SCS Field Services, Tampa, FL.

Background Discussion

Manatee County had defined a need to select a Design/Build/Operator to provide an enclosed structure and a generator to use Landfill gas from the Lena Road Landfill to produce electricity for the adjacent Southeast Water Reclamation Facility (aka Southeast Regional Wastewater Treatment Plant (WWTP).

Using Landfill gas to generate electricity for the Southeast WWTP will produce significant savings in electrical costs for this WWTP. The power generating facility will have a life expectancy of thirty (30) years.

At the current electric rates, the asset will pay for itself in approximately seven (7) years.  

The design portion is now complete and approved by the County.  The GMP is submitted for approval in accordance with the Agreement, in the form of an Addendum with a Guaranteed Maximum Price (GMP). The County is not obligated to compensate the Design/Build/Operator for any costs above the GMP amount in the Agreement.  

The construction phase is set to commence upon County approval of the (GMP) and is scheduled to be completed in 365 calendar days from Board of County Commissioners approval.

On 10/19/2012 Initial negotiations to establish the Guaranteed Maximum Price (GMP) commenced with Sterns, Conrad & Schmidt Consulting Engineers, Inc. (SCS) and County staff. Negotiations concluded on 10/31/2012 with an amount for the (GMP) of $3,918,644.00. The price established is found to be fair and reasonable to the County and the Design/Builder/Operator.

Upon completion of the construction phase the Design/Builder/Operator will monitor, operate and maintain the facility for the next ten years. The cost for this service was established in the original Agreement at a price of .0285 cents per generated kilowatt hour.
