Reimbursement Agreement for Rye Road Sewer Line Improvements

Authorize the Chair to execute the Reimbursement Agreement for Rye Road Sewer Line Improvements between the County and D.R. Horton, Inc.
Section 125.01, Florida Statutes
The Developer is the owner and developer of the real property in Manatee County, Florida, commonly known as "Del Tierra" ("Developer's Project"). The Developer's project is located off Rye Road and currently served by an existing 6-inch sanitary sewer line that is in need of increased capacity. The Developer and the County have agreed that the construction of an expanded sewer line and related improvements (the "Sewer Line Expansion Project") will benefit the Developer's Project and the surrounding greater community.
Manatee County has designed and funded the construction of the Sewer Line Expansion Project and the Developer is willing to construct the County's Plan/Final Scope. The Developer and the County both desire to expedite the construction of the Sewer Line Expansion Project.
The County shall reimburse the Developer for one hundred percent (100%) of the actual cost incurred by the Developer for the construction described in the Final Scope. The County's obligation to reimburse the Developer shall not exceed the sum of one million, eight hundred thirty-nine thousand, three hundred forty-three dollars and forty-two cents ($1,839,343.42) for the Final Scope of work with an additional sum of one hundred, thirty-three thousand and 00/100 dollars ($133,000.00), as contingency for unforeseen conditions or any conflict.
The Developer specifically agrees that there will be no impact fee credits requested or provided to the Developer for the improvements constructed pursuant to this agreement.
Manatee County passed an increase in the sewer connection fee also known as Facility Investment Fee (FIF) in the amount of $712.00 for a single family detached dwelling. The Developer did not pay this increase for 121 homes that have been completed at Del Tierra, prior to enacting the increase. In conjunction with this Agreement, the Developer has agreed to pay to the County the sum of eighty-six thousand, one hundred fifty-two and 00/100 dollars ($86,152.00), representing the $712.00 per home increase, for the 121 homes.
