Action Requested

RECOMMENDED MOTION:

Based upon the staff report, evidence presented, comments made at the Public Hearing, the action of the Planning Commission, and finding the request to be CONSISTENT with the Manatee County Comprehensive Plan and the Manatee County Land Development Code, as conditioned herein, I move to ADOPT Manatee County Zoning Ordinance No. PDMU-06-16(P)(R5); amending and restating Ordinance No. PDMU-06-16(P)(R4); and APPROVE the Preliminary Site Plan with conditions; for a project that was previously granted Special Approval in the RES-6 and MU Future Land Use Categories; and for a project that was previously granted Specific Approval of an alternative to Sections 603.11.4.3, 702.6.10, 710.1.6, 714.8 and 702.6.8 of the Land Development Code, as recommended by the Planning Commission.

Background Discussion
  • The University Groves rezone and Preliminary Site Plan were approved on April 22, 2003.  The 142.15± acre project consists of a mix of residential, office, and commercial uses. The following amendments were previously approved for the project:
    - 06/20/2006: Received approval for an extension of the CLOS and minor changes to the site plan and development entitlements.
    - 06/04/2009: Received approval for various development options relative to uses in Areas I-VI.
    - 06/23/2009: Received approval for setback reduction and specific approval for waterfront yard reduction in The Residences at University Groves subdivision. 
    - 01/07/2010: Received approval to reduce side yard setbacks for three additional lots in The Residences at University Groves subdivision. 
    - 02/03/2011: Received approval to allow an option for recreational area improvements to be constructed at the Townhouse Residences at University Groves (pool and clubhouse optional amenities).

• The applicant requests approval to amend the Zoning Ordinance and Preliminary Site Plan to allow :
- More diversity of non-residential uses including medium and large residential support uses (daycare center, school of special education, and private elementary school), medical and dental laboratories, medium intensity recreation uses, motor vehicle services, and memory care residential treatment facilities.
- Increase commercial square footage with a simultaneous decrease in office square footage.
- Increase the number group care home beds from 100 to 120 beds and residential treatment facility beds from 60 to 80.
- No changes are proposed at this time for the residential areas of the project.
- The proposal contemplates to modify development options for the Office Parcel and Mixed Uses Parcel to:
º incorporate new uses in each area,
º define new limits for the Mixed Use Area IV, and define a new Area VI (the preliminary site plan identifies the possible uses and layout for each area).
- Increase the height of some buildings: hotel, group care home, multi-family (ILF), and Building # 37.
- No increase in non-residential square footage proposed with this request.

  •  Staff recommends approval of the proposed changes.
  • On July 11, 2013, by a vote of 7 – 0, the Planning Commission recommended approval. 
  • A summary of public comments from the July 11, 2013 Planning Commission public hearing are in the staff report attached to this memo.
