Adopt Resolution R-16-136 authorizing deferral of proportionate share mitigation for school concurrency for the Indigo Phase VI and VII land development project.
Resolution No. R-16-136
The Manatee County School Board has determined that insufficient high school capacity exists to serve Indigo Phases VI and VII. The project may not receive a Certificate of Level of Service (CLOS) for school concurrency under the concurrency management system unless and until the landowner enters into an agreement with the County and the School Board to provide proportionate share mitigation for high school capacity.
County staff is working with staff from the School Board to develop a standardized agreement and school impact fee credit process that can be used as a standard form of agreement for these purposes. This resolution, R-16-136, serves as an interim process for this development and can be used by others in similar circumstances that are at the later stages of their development process, prior to the finalization of an interlocal agreement process for proportionate mitigation of school impacts. Execution of the three party agreement and payment of the proportionate share amount will be required prior to the issuance of the first certificate of occupancy for the units receiving concurrency approval through this resolution.
